These Terms and Conditions ("Terms") govern use of the GrowBold Digital ("GrowBold," "we," "us," or "our") platform, and the SMS and email messaging program offered through it. By using our platform or by opting in to receive messages from a business using GrowBold, you agree to these Terms.

1. Description of Service

GrowBold provides small, owner-operated local businesses with software to send SMS text messages and emails to their own customers, including appointment reminders, account updates, and promotional offers. GrowBold acts as the technology provider; the business you interact with is the sender and is responsible for its own messaging content and customer relationships.

2. SMS Program Terms

Program name: GrowBold Digital Customer Messaging, text messages sent on behalf of local businesses using the GrowBold platform.
You must opt in to receive SMS messages from a business before messages are sent. Appointment and account texts and promotional texts are two separate, optional consents, each with its own unchecked box. Consent to either is not a condition of purchase, and agreeing to one does not sign you up for the other.
Message frequency varies by business and your interactions with it: up to 30 appointment and account messages per month, and up to 30 promotional messages per month, only if you chose that option.
Message and data rates may apply, depending on your mobile carrier and plan.
To opt out at any time, reply STOP to any message. You will receive a one-time confirmation that you have been unsubscribed, and no further messages will be sent unless you opt in again.

Supported carriers include but are not limited to AT&T, T-Mobile, Verizon, and other major US wireless carriers. Carriers are not liable for delayed or undelivered messages.

3. Acceptable Use

You agree not to use the GrowBold platform to send unlawful, deceptive, or unsolicited messages, or messages to any recipient who has not provided consent. GrowBold reserves the right to suspend or terminate access for any use that violates these Terms, carrier requirements, or applicable law (including TCPA and CTIA guidelines).

4. No Warranty; Limitation of Liability

The platform is provided "as is" without warranties of any kind. To the maximum extent permitted by law, GrowBold is not liable for indirect, incidental, or consequential damages arising from use of the platform or messaging program.

5. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform or continued participation in the messaging program after changes take effect constitutes acceptance of the updated Terms.
